Terms of Use & Membership

Effective September 20, 2026

Please read these Terms carefully. These Terms govern website and network use. Paid membership requires affirmative acceptance of the membership terms and separate recurring-payment authorization before any charge. Reading this website or emailing an application does not enroll you or authorize billing.

1. About MDRS

Mediation & Dispute Resolution Specialist (“MDRS,” “we,” “us,” or “our”) operates a mediation information and referral network. MDRS may receive requests, review basic case criteria, display anonymized opportunities to eligible network members, and facilitate an introduction between a requesting party and a selected independent mediator.

Current availability: The client area, mediator application, anonymous referral board, approved-member directory, basic preparation resources and MDRS administration area are available through the portal. Accounts use Sign in with ChatGPT. Paid access requires approval and payment verification. Checkout is available only when MDRS connects its payment provider. Automatic payment synchronization and email alerts are not included; MDRS reviews portal activity and verifies renewals manually. No subscription begins from an application or sign-in.

2. Information and referral service only

Website content is general information and is not legal advice. Use of the website does not create an attorney-client relationship, fiduciary relationship, or mediator-party relationship with MDRS. MDRS does not decide disputes, guarantee settlement, predict court outcomes, or advise any person whether to accept an agreement. Consult a qualified attorney about your rights, deadlines, and legal options.

3. Independent mediators

Network mediators are independent professionals and are not employees, agents, partners, or legal representatives of MDRS. Each mediator is responsible for maintaining all training, qualifications, insurance, disclosures, conflicts checks, professional obligations, and other requirements applicable to the services offered. Profile review or network membership is not a guarantee, certification, or warranty of a mediator’s performance or suitability.

4. Referrals and client information

MDRS may share anonymized information—such as general matter type, county, requested format, session length, representation status, and general timing—with eligible mediators. Names, direct contact information, and identifying details are intended to be released only to a selected mediator as reasonably necessary to make the requested introduction. MDRS may decline, pause, reassign, or withdraw a referral when necessary for availability, conflicts, safety, accuracy, nonresponse, or program administration.

Submitting a request does not guarantee that a mediator will be available or that MDRS will make a match. Membership does not guarantee any minimum number of referrals, bookings, clients, revenue, or professional opportunities.

MDRS will confirm your permission before releasing identifying information to a proposed mediator for a private conflicts check or introduction. If that mediator cannot accept, MDRS will seek permission before introducing another. Do not submit another person’s private details without lawful authority. No requester can consent to mediation or waive confidentiality for every other party merely by submitting a request. Membership payments fund access and resources; they do not purchase client contact lists or guarantee selection.

5. Mediation confidentiality

Texas law may protect communications and records made in an alternative dispute resolution procedure, including under Texas Civil Practice and Remedies Code Chapter 154. However, sending information through this website or by ordinary email before a mediation begins may not, by itself, create a mediation communication or make the information privileged or confidential under that law. Do not send Social Security numbers, complete financial-account numbers, medical records, evidence, detailed allegations, or other highly sensitive case materials through the public website or ordinary email. The selected mediator’s agreement will govern the actual mediation process and applicable confidentiality obligations.

Confidentiality is subject to statutory exceptions, including applicable abuse or neglect reporting duties, independently discoverable evidence, and legally required disclosures. A private agreement cannot override those duties. Referral requests do not pause court, filing, appeal, or limitation deadlines. Parties remain responsible for court orders, attendance obligations, legal advice, and authorized settlement decisions. MDRS does not provide emergency assistance.

6. Eligibility and accounts

You must be at least 18 years old and legally capable of entering a contract. You must provide accurate, current information and promptly update material changes. Account credentials are personal and may not be shared. You are responsible for activity under your account and must promptly report suspected unauthorized access.

7. Mediator membership and recurring billing

The founding mediator membership is currently offered at $49 per month unless a different price is clearly disclosed at checkout. By enrolling, you authorize the designated payment processor to charge the disclosed membership price, plus applicable taxes, on a recurring monthly basis until canceled. No charge will be made until membership is approved, the included services are available, and you affirmatively accept the disclosed price, renewal schedule, cancellation method, and final-payment policy. The renewal date will be provided at enrollment. An application is not a paid membership; there is no lifetime price guarantee unless expressly agreed in writing.

You may cancel before the next renewal through the available account or billing portal, or by emailing mdrsbooking@gmail.com. Cancellation stops future renewals and does not automatically refund a charge already processed. Access continues through the paid billing period following voluntary cancellation unless suspended for a material breach. A cancellation received before renewal stops that renewal even if our acknowledgment follows later. We will confirm cancellation and correct any charge processed after a timely cancellation. No additional cancellation fee applies.

Final-payment policy: Except where required by applicable law, all payments to MDRS are final and nonrefundable once processed, including membership charges. MDRS does not provide prorated refunds or credits for unused time, lack of referrals, failure to pursue an opportunity, or voluntary cancellation after a renewal has occurred. This policy does not limit rights relating to unauthorized charges, duplicate charges, processing errors, or other rights that cannot lawfully be waived.

MDRS will give at least 30 days’ notice before a price increase or material reduction of paid benefits, allow cancellation before it takes effect, and obtain renewed consent where required. No change applies retroactively or overrides an express price commitment. Failure to pay may result in suspension or termination of access.

If MDRS cancels membership without member breach or permanently discontinues paid services, MDRS will refund prepaid fees attributable to the unavailable period. The final-payment policy does not authorize billing for services never activated. Contact MDRS about billing errors; nothing requires you to surrender a lawful bank or card dispute right.

8. Mediator fees and separate agreements

MDRS charges clients no $99 booking fee under this model. The selected mediator—not MDRS—sets, contracts for, collects, and administers the mediator’s professional fee. Any deposit, cancellation, rescheduling, refund, or payment dispute concerning the mediation itself is governed by the agreement between the mediator and the parties. MDRS does not receive a percentage of the mediator’s fee and is not responsible for collecting, holding, refunding, or resolving disputes over those separate payments.

9. Member standards

Members must act honestly and professionally; protect nonpublic referral information; conduct appropriate conflicts checks; avoid contacting or soliciting an anonymized client outside the MDRS introduction process; avoid misrepresenting qualifications, availability, results, or affiliation; and comply with applicable law, court rules, contracts, ethical standards, and confidentiality duties. Referral information may be used only to evaluate and perform the applicable mediation opportunity.

Before accepting a matter, members must disclose conflicts and relationships affecting impartiality, confirm applicable qualifications and court requirements, obtain the parties’ agreement to mediate, disclose all professional fees and cancellation terms, and assess safety, coercion, and whether mediation is appropriate. Family matters require attention to family-violence concerns and applicable training rules. Attorney members remain responsible for their separate professional rules; membership is not an attorney referral or legal representation engagement.

Members must use private referral data only for the authorized matter; must not reidentify anonymous summaries, sell or redistribute leads, add parties to marketing lists, or upload case information to public AI services. Protect devices and accounts, restrict access, promptly notify MDRS of suspected loss or unauthorized disclosure, cooperate with lawful response and deletion requests, and securely delete unsuccessful referral details unless retention is legally required. A withdrawn referral does not cancel an already signed mediator-party agreement.

10. Acceptable use

You may not misuse the website; attempt unauthorized access; scrape or copy referral listings; introduce malicious code; interfere with security; impersonate another person; use information for harassment, discrimination, surveillance, or unlawful solicitation; or submit content you do not have authority to provide.

11. Intellectual property

The website, MDRS branding, original text, design, resource materials, and compilation of referral information are owned by or licensed to MDRS and are protected by applicable law. A membership grants a limited, personal, nonexclusive, nontransferable, revocable right to use included resources for the member’s own professional practice. Materials may not be resold, publicly distributed, sublicensed, or used to create a competing database without written permission.

Members retain ownership of their submitted profile content and grant MDRS a nonexclusive license to display approved professional content to operate the directory while listed. Client information is not licensed for advertising. Templates are general aids, not legal advice, guaranteed court-approved forms, or accredited continuing education unless specifically identified; members must adapt them to applicable requirements.

12. Suspension and termination

MDRS may suspend or terminate access for nonpayment, false information, misuse of referral data, circumvention of the referral process, confidentiality concerns, complaints presenting a credible risk, legal or security requirements, or material violation of these Terms. Provisions that by their nature should survive termination—including payment obligations, confidentiality, intellectual property, disclaimers, and dispute provisions—will survive.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, NETWORK, REFERRALS, AND RESOURCES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” MDRS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. MDRS DOES NOT WARRANT UNINTERRUPTED ACCESS, A PARTICULAR MATCH, A SETTLEMENT, A CASE OUTCOME, A NUMBER OF REFERRALS, OR INCOME.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MDRS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, OPPORTUNITIES, OR GOODWILL; OR THE ACTS, OMISSIONS, ADVICE, FEES, SCHEDULING, AGREEMENTS, OR SERVICES OF AN INDEPENDENT MEDIATOR. MDRS’S AGGREGATE LIABILITY ARISING FROM THE PAID MEMBERSHIP WILL NOT EXCEED THE AMOUNT THE CLAIMANT PAID TO MDRS DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT EXCLUDE MDRS’S FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, OR LIABILITY THAT CANNOT LAWFULLY BE LIMITED, AND DO NOT ELIMINATE EXPRESS REFUND OBLIGATIONS.

15. Indemnification

To the extent permitted by law, a member agrees to defend, indemnify, and hold MDRS harmless from third-party claims, losses, and reasonable expenses arising from the member’s professional services, violation of law, misuse of referral information, breach of these Terms, or infringement of another person’s rights.

This indemnity applies only to the extent caused by the member’s conduct and does not cover MDRS’s own negligence or misconduct. MDRS will provide prompt notice and reasonable cooperation; no settlement may admit fault or impose nonmonetary obligations on MDRS without its consent, which will not be unreasonably withheld.

16. Disputes, governing law, and venue

These Terms are governed by Texas law, without regard to conflict-of-law principles. Before filing a lawsuit arising from these Terms, the parties will first provide written notice and attempt in good faith to resolve the dispute informally for at least 30 days. If unresolved, the parties agree to attempt mediation in Harris County, Texas, with a mutually acceptable neutral before pursuing litigation, unless emergency relief or applicable law requires otherwise. If a neutral cannot be agreed upon or mediation held within 30 days after the informal period, either party may proceed. These steps do not bar small-claims proceedings, regulatory complaints, emergency relief, or timely filings needed to preserve rights; they do not extend statutory deadlines. MDRS will not administer or mediate a dispute against itself. Mediation costs require agreement. Exclusive venue for litigation will lie in a court of competent jurisdiction in Harris County, Texas. Nothing in these Terms waives a nonwaivable consumer right or remedy.

17. Changes and electronic communications

MDRS may update these Terms prospectively by posting a revised effective date and, for material membership changes, providing reasonable notice through the website, account, or email. Electronic notices and records will be used where permitted by law, with additional consent where required. A general website notice does not replace separate billing or sensitive-data consent. Material changes are prospective and do not rewrite accrued claims.

18. General provisions

These Terms and any incorporated checkout or membership disclosures constitute the agreement concerning the website and network. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not transfer your membership without written consent.
